Terms of Service

1. Introduction and Acceptance

These Terms of Service ("Terms") govern your use of Clueshot ("the Service"), a photo-based scavenger hunt platform operated by Analardo Games ("we", "us", "our"). By creating an account or using the Service, you agree to be bound by these Terms. If you do not agree to these Terms, please do not use the Service.

2. Service Description

Clueshot allows users to create and play photo-based scavenger hunts. Creators upload photos of real-world locations along with password clues hidden at those locations. Players follow the photos, find the physical clues, and enter the passwords to progress through the game.

3. Account Registration

To create games, you must register for an account using a valid email address or Google sign-in. You agree to:

• Provide accurate and complete registration information.
• Maintain only one account per person.
• Keep your login credentials secure and not share them with others.
• Notify us immediately of any unauthorized use of your account.

Playing games does not require an account.

4. User-Generated Content

You may upload photos, game titles, step descriptions, and password clues ("User Content") as part of creating games on Clueshot. By uploading User Content, you agree to the following:

• Ownership: You retain ownership of the User Content you upload.
• License: You grant Analardo Games a worldwide, non-exclusive, royalty-free license to store, display, and distribute your User Content solely for the purpose of operating and providing the Service.
• Responsibility: You are solely responsible for the User Content you upload. You warrant that you have the right to upload such content and that it does not infringe any third-party rights, including intellectual property, privacy, or publicity rights.
• Accessibility: Photos and game data you upload are accessible to anyone who has the game link. You acknowledge that there is no additional access control beyond the link itself, and you should not upload content that you wish to keep private.
• Prohibited Content: You must not upload content that is illegal, obscene, defamatory, threatening, harassing, discriminatory, or otherwise harmful. You must not upload photos containing identifiable individuals without their consent.
• Removal: We reserve the right to remove any User Content that violates these Terms, without prior notice.
• Persistence: If you delete your account, games you created will remain accessible and playable, but will no longer be linked to your identity. Photos associated with those games will remain as part of the game content.

5. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose.
• Upload malicious code, viruses, or any harmful content.
• Attempt to gain unauthorized access to the Service or its systems.
• Use automated tools (bots, scrapers) to access the Service.
• Interfere with or disrupt the Service or its infrastructure.
• Impersonate any person or entity.
• Reverse engineer, decompile, or disassemble any part of the Service.

6. Intellectual Property

The Clueshot name, logo, design, and underlying code are the property of Analardo Games. You may not use our trademarks, logos, or branding without prior written permission. These Terms do not grant you any rights to our intellectual property except the limited right to use the Service as described herein.

7. Account Deletion

You may delete your account at any time through the user menu in the application. Upon deletion:

• Your profile data (email, account information) will be permanently deleted.
• Your game progress and play history will be permanently deleted.
• Games you created will become anonymous but will remain playable for anyone with the link.
• This action is irreversible.

8. Paid Subscriptions

Clueshot offers a free tier and a paid subscription plan ("Clueshot Pro").

• Free Tier: You may create up to 1 game with up to 5 steps per game. Playing games is always free and unlimited.
• Clueshot Pro: $5.00 USD per month. Includes unlimited games, unlimited steps per game, and a Pro badge on your avatar.
• Payment Processing: All payments are processed securely by Stripe. By subscribing, you also agree to Stripe's Terms of Service.
• Automatic Renewal: Your subscription renews automatically each billing cycle. You may cancel at any time through the subscription management portal accessible from your Profile page.
• Cancellation: Upon cancellation, you retain Pro access until the end of your current billing period. After that, your account reverts to the free tier.
• No Refunds: We do not provide refunds for partial billing periods.
• Existing Content: Games and steps created before subscription limits were introduced remain fully accessible and playable, regardless of your current subscription tier.
• Price Changes: We reserve the right to change subscription pricing with at least 30 days' prior notice. Price changes will apply to the next billing cycle after the notice period.

9. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

10. Limitation of Liability

To the maximum extent permitted by applicable law, Analardo Games shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of the Service. This includes, without limitation, damages for loss of data, loss of profits, or damages arising from User Content uploaded by any user.

Analardo Games is not responsible for the accuracy, legality, or appropriateness of any User Content.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Czech Republic and applicable European Union regulations. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of the Czech Republic.

12. Changes to These Terms

We may update these Terms from time to time. When we do, we will update the "Effective" date at the top of this page. Your continued use of the Service after any changes constitutes acceptance of the updated Terms. We encourage you to review these Terms periodically.
